Legitimation & Paternity

In the instance a child is born out of wedlock, an action for legitimation is the first step in the legal process to have visitation or custody of the child, seek support from the other parent, or for the child to be an heir to an inheritance. The court will only legitimate the child if the court believes that the legitimation is in the child’s best interests. Legitimation does not automatically equal joint custody.
